Accurate timesheets protect both in-home care workers and client families. Under federal Fair Labor Standards Act (FLSA) regulations and state wage orders, non-exempt home care workers and CNAs are entitled to pay for all hours worked, including overtime and sleep-time disruptions during overnight live-in care.
- Documentation of Hours: Record exact start and end times for every shift. Rounding practices must be neutral and comply with state labor board guidelines.
- Overnight Care Provisions: In 24-hour residential care shifts, sleep time (up to 8 hours) can only be deducted if the caregiver gets at least 5 hours of uninterrupted sleep. Any interruptions must be paid as working time.
- Signature Verification: Have the client or their family power of attorney sign off at the conclusion of each pay period to verify services before submitting to Medicaid, VA Community Care, or private pay billing.
